Devyani Khobragade seeks dismissal of visa fraud case

Indian diplomat Devyani Khobragade appealed in a federal court to dismiss the visa fraud case against her the day after her return to India. Her lawyer Daniel Arshack submitted a four-page document for "motion seeking dismissal of action for lack of personal jurisdiction" on 09th Jan 2014. Devyani Khobragade was found guilty for visa fraud and making false statements. She flew back to India on an Air India flight after she got diplomatic immunity.

The US State department has assured Devyani Khobragade that her departure in compliance with their order does not constitute a violation of the terms of her release from the court on bond of $250,000 on the charges she faces.

Her lawyer said that since Devyani has been given diplomatic status, she has "automatically" been vested with diplomatic immunity from criminal liability in the US while she continues to maintain such diplomatic status.
